"Demo" refers to the interactive AI receptionist demonstration available on our Website.
Eligibility
Our Services are designed for HVAC and roofing businesses operating in the United States. By using our Services, you represent that you are at least 18 years of age and have the legal authority to enter into a binding agreement on behalf of yourself or your business.
Description of Services
GetCallsBack provides AI-powered receptionist services specifically designed for HVAC and roofing companies. Our Services may include:
24/7 automated call answering in your company's name
Lead qualification and customer information capture
Emergency call detection and priority SMS alerts
Automatic appointment booking integrated with your scheduling tools
Spam and non-service call filtering
Monthly performance and ROI reports
Integration with third-party tools including ServiceTitan, Jobber, Housecall Pro, Go HighLevel, Acculynx, JobNimbus, Roofr, CompanyCam and EagleView.
The specific features and scope of Services provided to each Client will be determined during the onboarding process and outlined in a separate service agreement.
Website Demo
Our Website features an interactive AI receptionist demo powered by ElevenLabs technology. This demo is provided for demonstration purposes only and is intended to showcase the capabilities of our AI receptionist. The demo does not constitute a commitment to deliver identical performance or results.
By using the demo, you consent to the processing of your voice data during the interaction. Voice data is processed in real-time for the purpose of generating AI responses and is not permanently stored by GetCallsBack.
Booking and Strategy Calls
Our Website allows you to schedule a Free Strategy Call through our booking system powered by Cal.com. By booking a strategy call, you agree to provide accurate contact and business information. Strategy calls are free of charge and carry no obligation to purchase our Services.
We reserve the right to cancel or reschedule strategy calls at our discretion. We will make reasonable efforts to notify you in advance of any cancellation or rescheduling.
Pricing and Payment
Pricing for our Services is customized based on each Client's specific needs, including call volume, required features, and integrations. Detailed pricing will be provided during or following your strategy call and will be formalized in a separate service agreement before any charges are applied.
No charges will be applied without your explicit consent and a signed service agreement.
Service Agreement
Upon agreeing to use our Services, a separate Service Agreement will be executed between GetCallsBack and the Client. The Service Agreement will outline the specific terms of service, including scope, pricing, payment terms, duration, and termination conditions.
In the event of a conflict between these Terms and a Service Agreement, the Service Agreement will prevail.
Client Responsibilities
As a Client using our Services, you agree to:
Provide accurate and complete business information during onboarding
Maintain valid and active phone numbers, scheduling tools, and integrations required for the Services to function properly
Comply with all applicable laws and regulations, including those related to telecommunications and consumer protection
Not use our Services for any unlawful, fraudulent, or harmful purpose
Notify us promptly of any changes to your business information that may affect the delivery of our Services
10. Intellectual Property
All content on our Website, including but not limited to text, graphics, logos, images, software, and design, is the property of GetCallsBack or its licensors and is protected by intellectual property laws.
You may not reproduce, distribute, modify, create derivative works of, publicly display, or otherwise exploit any content from our Website without our prior written consent.
The GetCallsBack name and logo are trademarks of 3D World Spain SL. You may not use our trademarks without our prior written permission.
11. AI Technology Disclaimer
Our AI receptionist uses artificial intelligence technology to interact with callers. While we strive for accuracy and natural-sounding conversations, you acknowledge and agree that:
The AI receptionist may occasionally misinterpret caller requests or provide imperfect responses
The AI receptionist is not a substitute for professional emergency services. In the event of a life-threatening emergency, callers should contact 911 directly
We continuously improve our AI technology, but we cannot guarantee 100% accuracy in call handling, appointment booking, or emergency detection
Call recordings and transcripts may be used to improve our Services, subject to our Privacy Policy
12. Limitation of Liability
To the fullest extent permitted by applicable law:
GetCallsBack shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to your use of our Website or Services.
Our total liability for any claim arising from or related to our Services shall not exceed the total amount paid by you to GetCallsBack in the twelve (12) months preceding the event giving rise to the claim.
We are not liable for any losses resulting from missed calls, failed emergency detection, incorrect appointment bookings, or other AI errors, except to the extent caused by our gross negligence or willful misconduct.
We are not liable for any interruptions, delays, or failures in service caused by third-party providers, internet connectivity issues, or circumstances beyond our reasonable control.
13. Indemnification
You agree to indemnify, defend, and hold harmless GetCallsBack, its officers, directors, employees, and agents from any claims, liabilities, damages, losses, or expenses (including reasonable legal fees) arising from your use of our Website or Services, your violation of these Terms, or your violation of any applicable law or third-party rights.
14. Third-Party Services
Our Website and Services may integrate with or contain links to third-party services, including but not limited to Cal.com, Google Analytics, ElevenLabs, ServiceTitan, Jobber, and Housecall Pro. For Clients based in the United States, any disputes arising from or related to these Terms or our Services shall first be attempted to be resolved through good-faith negotiation. If negotiation fails, disputes shall be submitted to binding arbitration in accordance with the rules of the American Arbitration Association (AAA), with the arbitration taking place remotely or in a mutually agreed location.
For all other users, disputes shall be subject to the exclusive jurisdiction of the courts of Spain.
Nothing in this section limits your right to bring claims in small claims court if your claims qualify.
18. Severability
If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions will continue in full force and effect.
19. Entire Agreement
These Terms, together with our Privacy Policy and any applicable Service Agreement, constitute the entire agreement between you and GetCallsBack regarding the use of our Website and Services.
